Terms and Conditions for XBrikol

Please read these Terms and Conditions ("Terms") carefully before using the XBrikol mobile application (the "Service") operated by XBrikol ("us," "we," or "our").
By accessing or using the Service, you agree to be bound by these Terms.
1. The Service: A SaaS Introductory Platform
XBrikol provides a Software as a Service (SaaS) platform that functions as an independent, neutral venue. Our software provides tools for independent home repair professionals ("Service Providers") to market their skills and for individuals ("Customers") to find and contact them.
In exchange for your agreement to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the XBrikol software.
IMPORTANT CLARIFICATION OF OUR ROLE:
You acknowledge and agree that the "Service" provided by XBrikol is the software platform itself, and nothing more.
We license the use of our software; we do not provide physical handyman services.
We are an introductory service only. We are not involved in the service agreements, the work performed, or the payments for that work.
All Service Providers are independent contractors and are not employed or endorsed by XBrikol.
2. User Accounts
To use the Service, you must register for an account. You must be at least 18 years old. You agree to provide accurate and current information. You are responsible for all activity that occurs under your account.
3. Fees and Payment Structure
a) For Customers:
The license to use the XBrikol software to find and contact Service Providers is granted to Customers free of charge.
b) For Service Providers:
To access the software's features for marketing, receiving customer requests, and connecting with Customers, Service Providers must purchase "Platform Credits." These credits function as payment for the license to use the software's lead generation and communication tools. The cost and usage rate of these credits are detailed within the Service. All purchases of Platform Credits are final and non-refundable.
c) Payment for Handyman Services: OFFLINE & INDEPENDENT
This is a core condition of using our SaaS platform:
Payment for all work performed is arranged and made DIRECTLY between the Customer and the Service Provider, offline (e.g., in cash).
XBrikol IS NOT INVOLVED IN THIS FINANCIAL TRANSACTION. We do not process payments for jobs, provide receipts, guarantee payment, or mediate payment disputes. Our platform's role ends once a connection is made.
4. User Conduct
All users agree to use the software platform for its intended purpose and in a lawful manner. You agree not to reverse-engineer, decompile, or otherwise attempt to discover the source code of the XBrikol software.
5. Specific Terms for Service Providers
As a Service Provider licensing our software, you represent and agree that:
You are an independent business, not an employee of XBrikol.
The software license is granted to you solely to market your own independent services.
You are solely responsible for negotiating your rates, performing professional work, and collecting your payment directly from the Customer.
You are responsible for your own taxes, insurance, and business licenses.
6. Disclaimers and Limitation of Liability
a) Disclaimer for Software Platform (SaaS):
The XBrikol software is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the software will be uninterrupted, secure, or error-free.
b) Disclaimer for Offline Services and Transactions:
Since we are not involved in the offline service agreement or payment, we explicitly disclaim all liability for any and all claims arising from your interaction with other users. This includes, but is not limited to: disputes over quality of work, payment failures, property damage, or personal injury.
c) Limitation of Liability:
TO THE FULLEST EXTENT PERMITTED BY LAW, XBRIKOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER. OUR TOTAL LIABILITY TO A SERVICE PROVIDER FOR ANY CLAIM ARISING FROM THE USE OF OUR SOFTWARE WILL NOT EXCEED THE TOTAL AMOUNT OF PLATFORM CREDITS PURCHASED BY THAT USER IN THE THREE (3) MONTHS PRIOR TO THE CLAIM. AS THE SOFTWARE IS FREE FOR CUSTOMERS, YOU ACKNOWLEDGE THAT OUR TOTAL LIABILITY TO A CUSTOMER IS NIL.
7. Termination
We may terminate or suspend your license to use the Service and close your account at any time, without notice, for any reason, including a breach of these Terms.
8. Intellectual Property
The Service, including all underlying software, is the exclusive property of XBrikol.
9. Governing Law
These Terms shall be governed by the laws of the Kingdom of Morocco.
10. Changes to Terms
We may modify these Terms at any time. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
